This notice is a legal agreement and constitutes the entire understanding between you (an individual or single entity, referred to hereinafter as "you") and Seiko Epson Corporation ("Epson") regarding "Sample Source".You can download the Sample Source, and then you can modify and change a part or whole of the Sample Source pursuant to the following terms and conditions:

 

As for the Sample Source, you shall not (i) reprint and reproduce to the other media; (ii) distribute; and (iii)　upload onto a server so it is accessible via a public network such as the Internet. The Sample Source shall be obtained ONLY through this web site and with your agreement to this Notice.    

●Prohibited Application Area
Notwithstanding any licenses granted hereunder, you shall not use the Sample Source for any of the following purposes:

（i）Military purposes

（ii）Life-sustaining purposes

（iii）Any other purposes having (or assumed to) affect to human body

（iv）Combination with any IC products other than Epson's IC (into which the Sample Source integrate or supposed to integrate)

 

（v）Design and Development of any IC products whose functions are similar with those of Epson's IC

YOU ACKNOWLEDGE AND AGREE THAT THE SAMPLE SOURCE IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTY OF ANY KIND, AND THAT THE USE OF THE SAMPLE SOURCE AND THE MODIFIED SAMPLE SOURCE IS AT YOUR OWN RISK. EPSON DO NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE SAMPLE SOURCE AND THE MODIFIED SAMPLE SOURCE. EPSON MAKE NO WARRANTIES, EXPRESS OR IMPLIED, AS TO NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. 

 

●Limitation of Liability
 IN NO EVENT WILL EPSON BE LIABLE TO YOU, WHETHER ARISING UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, FOR ANY DIRECT, CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS, OR LOST DATA, EVEN IF EPSON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM FROM ANY THIRD PARTY. EPSON HAS NO LIABILITY FOR CLAIMS FROM ANY THIRD PARTIES REGARDING THE MODIFIED SAMPLE SOURCE EVEN IF SUCH CLAIM IS ORIGINATED TO THE SAMPLE SOURCE.

 

●Export Control
You acknowledge that you shall comply with all applicable export laws, restrictions, and regulations of any Japanese or foreign agency or authority and will not export or re-export, or allow the export or re-export of the Sample Source, the Modified Sample Source, and any related technology or information without first obtaining all necessary approvals and/or licenses therefore.  

 

●Governing Law
 This Notice shall be construed and governed by the law of Japan, without reference to conflict of law provisions.
